No Attorney-Client Relationship
Submitting accessibility feedback or a request for assistance through this website does not create an attorney-client relationship. Please do not include confidential or time-sensitive information in your communication until an attorney-client relationship has been established in writing.
Privacy Policy
This Privacy Policy explains how Hayden Smith Legal LLC, a Nevada limited liability company and law practice located in Las Vegas, Nevada (the “Firm,” “we,” “us,” or “our”), collects, uses, discloses, and protects information obtained through this website and related online communications (collectively, the “Website”). This Privacy Policy is intended to satisfy the online privacy notice provisions of Chapter 603A of the Nevada Revised Statutes (“NRS”) and applies only to information collected through the Website. It does not govern information the Firm receives in the course of an attorney-client relationship, which is protected by the Nevada Rules of Professional Conduct and the terms of the applicable engagement agreement.
No Attorney-Client Relationship. Contacting the Firm through the Website does not create an attorney-client relationship. An attorney-client relationship is formed only after the Firm completes a conflicts check and both the Firm and the client sign a written engagement agreement. Please do not submit confidential, privileged, or time-sensitive information, including information about a deadline, until the Firm has confirmed in writing that it represents you.

Cookies and Similar Technologies
The Website may use cookies, pixels, and similar technologies for essential functionality, security, preferences, performance measurement, and analytics. You may manage or disable cookies through your browser settings. Disabling cookies may affect the functionality of the Website.
Third-Party Tracking Across Websites
As required by NRS 603A.340(1)(d), the Firm discloses that third parties, such as analytics, advertising, or social media providers whose tools are used on the Website, may collect information about your online activities over time and across different websites or online services when you use the Website. The Firm does not permit those third parties to use information collected through the Website for any purpose other than providing services to the Firm, to the extent the Firm is able to control that use by contract or configuration.
How We Use Information
We use the information we collect to:
respond to inquiries, perform conflicts checks, and evaluate whether the Firm can consider a potential engagement;
schedule consultations and communicate with you about the Firm’s services;
operate, maintain, secure, and improve the Website;
detect and prevent fraud, misuse, and security incidents;
comply with legal, regulatory, professional, and ethical obligations, including obligations under the Nevada Rules of Professional Conduct; and

Submitting information through the Website does not obligate the Firm to accept a matter or to provide legal advice.
Confidentiality of Prospective Client Information
Information that a prospective client provides to the Firm in good faith to seek legal representation is treated as confidential consistent with Rule 1.18 of the Nevada Rules of Professional Conduct, even if no attorney-client relationship is formed. However, the Firm may need to use limited identifying information, such as names of parties, to perform a conflicts check, and the Firm may be unable to represent you if a conflict exists. Information sent to the Firm before a conflicts check is completed may not prevent the Firm from representing another party in the same or a related matter, except as provided in Rule 1.18.

Data Security
The Firm maintains reasonable administrative, technical, and physical security measures designed to protect personal information from unauthorized access, acquisition, destruction, use, modification, or disclosure, as required by NRS 603A.210. No website, email system, or method of electronic transmission is completely secure, and the Firm cannot guarantee absolute security. Nevada Privacy Rights

To do so, send an email to the designated request address listed in the Contact Us section below with “Nevada Privacy Request” in the subject line, and include your name and the email address or telephone number you used to contact the Firm.
The Firm will take commercially reasonable steps to verify your identity and the authenticity of your request. The Firm will respond to a verified request within 60 days after receipt. If reasonably necessary, the Firm may extend that period by up to 30 additional days and will notify you of the extension.
Reviewing and Requesting Changes to Your Information
You may review or request changes to the covered information you have submitted through the Website by contacting the Firm using the information in the Contact Us section below. The Firm will make reasonable efforts to correct inaccurate information, subject to the Firm’s legal and professional obligations to preserve records, including records needed for conflicts checks.
Consumer Health Data Privacy
Nevada law, at NRS 603A.400 to 603A.550, inclusive, provides additional protections for consumer health data. The Firm does not seek to collect consumer health data through the Website. However, a prospective client may choose to describe an injury, medical condition, treatment, or other health information when describing a legal matter. This section explains how the Firm handles that information.
Categories and sources. Information about a health condition, diagnosis, treatment, medication, or similar health information that you voluntarily provide when contacting the Firm. The Firm collects this information only from you or from a person acting on your behalf.

Processing. The Firm processes consumer health data only through its secure practice management, document management, email, and storage systems, and limits access to persons who reasonably need access to provide the services you request.
Sharing. The Firm may share consumer health data only with the categories of service providers and professional support described in the How We Disclose Information section, and only to the extent necessary to provide services you request, with your separate consent, or as required or authorized by law. The Firm does not sell consumer health data.
Third-party collection. The Firm does not permit third-party tracking technologies on the Website to collect consumer health data over time and across different websites or online services.
Subject to the Firm’s professional obligations and applicable exceptions, you may request that the Firm confirm whether it is collecting, sharing, or selling your consumer health data; provide a list of third parties with whom it has shared that data; stop collecting or sharing that data; or delete that data. To submit a request, email the address listed in the Contact Us section below with “Nevada Health Data Request” in the subject line. The Firm will authenticate your request and respond within 45 days after authentication, which may be extended by up to 45 additional days when reasonably necessary, with notice to you.
If the Firm declines to act on your request, you may appeal by emailing the same address with “Nevada Health Data Appeal” in the subject line. The Firm will inform you in writing of its decision within 45 days after receiving your appeal. If the appeal is denied, you may contact the Office of the Nevada Attorney General at ag.nv.gov.

The Firm will send marketing emails, newsletters, or text messages only as permitted by law, and you may opt out at any time by using the unsubscribe link in an email, replying “STOP” to a text message, or contacting the Firm. Opting out of marketing communications does not affect communications about an active matter.
Residents of Other States
The Firm is located in Nevada and directs its services primarily to persons in Nevada. If you reside in another state, you may have additional rights under the laws of that state. The Firm will honor any such rights to the extent the laws of that state apply to the Firm.
Third-Party Websites and Services
The Website may link to third-party websites or use third-party services. Their privacy practices are governed by their own policies, not this Privacy Policy. A link does not imply endorsement, and we encourage you to review the privacy policy of each website or service you use.
Children’s Privacy
The Website is not directed to children under 13 years of age, and the Firm does not knowingly collect personal information online from children under 13. If you believe a child has provided personal information through the Website, please contact the Firm so that it may take appropriate action. A parent or guardian seeking legal assistance on behalf of a minor should contact the Firm directly rather than permitting the minor to submit information through the Website.
Do Not Track and Global Privacy Signals
Some browsers transmit “Do Not Track” or other privacy preference signals. Because uniform standards for these signals have not been adopted, the Website does not currently respond to all such signals. The Firm will honor browser-based opt-out signals where required by applicable law.
Changes to This Privacy Policy
The Firm may update this Privacy Policy from time to time. When the Firm makes a material change, it will post the revised Privacy Policy on this page with an updated effective date and, where the change materially affects how the Firm uses or shares information you have already provided, will make reasonable efforts to notify you by email or by a prominent notice on the Website before the change takes effect. Your continued use of the Website after the effective date of a revised Privacy Policy constitutes acknowledgment of the revised Privacy Policy.
Governing Law
This Privacy Policy is governed by the laws of the State of Nevada, without regard to its conflict of laws principles.
